WA HIGH COURT DENIAL OF SEATTLE GUN BAN APPEAL

BELLEVUE, WA — The Second Amendment Foundation is delighted that the Washington State Supreme Court has unanimously denied the City of Seattle’s petition for review in the case of Winnie Chan v. City of Seattle, a legal action brought by SAF, the National Rifle Association and five individual plaintiffs.

The decision affirms the state’s long-standing preemption law and two lower court rulings, thus preventing the city from banning firearms from city parks property.

It was the third straight loss for the city, which had first attempted to ban firearms from park facilities under former Mayor Greg Nickels, in open defiance of Washington State’s model preemption statute. Following its initial loss in King County Superior Court, the city, under Nickels’ successor, Mayor Mike McGinn, appealed its loss to the State Court of Appeals. That court also ruled unanimously against the city, which petitioned the state high court last year for review.

“We are proud that the State Supreme Court panel, led by Chief Justice Barbara Madsen, unanimously rejected Seattle’s flagrant attempt to override state law and violate the civil rights of citizens living in or visiting the city,” said SAF founder and Executive Vice President Alan M. Gottlieb. “Mayor McGinn and the City Council should be ashamed that they pursued this pipe dream in an effort to turn the city into a banana republic. By letting the appeals court ruling stand, other anti-gun officials in city and county governments are on notice that they simply cannot ignore state law.

“We are equally proud of our partners in this important legal action,” he continued. “We were joined by the NRA, Washington Arms Collectors, the Citizens Committee for the Right to Keep and Bear Arms, and five courageous citizens. Our plaintiffs were willing to stand up to the city and public officials who seem determined to transform Seattle into a political gulag where a civil right can be dismissed at will in the interest of political correctness.

“And finally,” Gottlieb stated, “we are all very proud of our legal team led by Steve Fogg and Molly Malouf at Corr Cronin. They did a marvelous job, not only for their clients, but for the citizens of this state, whose civil rights apply everywhere, whether the City of Seattle likes it or not.”

I like the slidefire, I really do. But I don’t like the idea of burning through hundreds of dollars of 5.56 for the sake of simulated full auto. If only I could get this set up on a Ruger 10/22….hmmmm….

Dayton vetoes ‘castle doctrine’ self-defense bill

Gov. Mark Dayton vetoed the so-called “castle doctrine” self-defense bill on Monday.

The proposal, supported by the gun-rights groups and opposed by Minnesota’s law-enforcement organizations, would have expanded the legal justification for citizens who use deadly force in threatening situations.

The bill, sponsored by Rep. Tony Cornish, R-Good Thunder, and Sen. Gretchen Hoffman, R-Vergas, was the top priority of the National Rifle Association and drew some DFL votes in addition to near-unanimous Republican support. The measure passed by votes of 40-23 in the Senate and 85-47 in the House.

It would have changed the legal definitions of self-defense for someone facing a serious threat in their homes, and would have expanded this “castle doctrine” to cars, motor homes, boats and even tents.

It would have done away with a person’s duty to retreat when facing a threat in public places, which supporters called the “stand your ground” concept. It would also have legalized concealed-weapons permits issued by all states, regardless of their standards in granting permits, and limited the situations in which police can temporarily remove weapons from homes in volatile situations.

Law enforcement organizations strongly condemned the proposal, saying it could risk officers’ lives.

Dayton made his veto by letter without commenting publicly.

In his veto letter, Dayton said, he had to honor the opposition of law enforcement.

“The MN Police and Peace Officers Association, the MN Chiefs of Police and the MN Sheriffs Association represent the men and woman who risk their lives every day and night to protect the rest of us. When they strongly oppose a measure, because they believe it will increase the dangers to them in the performance of their duties, I cannot support it,” Dayton wrote.

Rep. Tony Cornish, a Republican from Good Thunder, said the opposition stemmed from the executives of law enforcement organizations “not the rank and file.” He said that the measure may take some time to become law but it will be back.

What this means for the rest of the country is our Governor does not want us to have reciprocity with many other states, and we won’t be guaranteed that we keep our firearms in case of a state of emergency like New Orleans during Hurricane Katrina. Also, if you travel to MN, you have a “duty to retreat” if a situation arises. What a bunch of horseshit. If you are from MN, Get ahold of your congressmen and women, most of them were on board with this bill. Let them know how unimpressed you are with Gov. Dayton’s decision. And if your’e not from MN, pretend.

Apparently another buying panic is underway?

And sales haven’t just risen in Texas. There’s been a rush nationwide, the Fort Worth Star-Telegram ( ) reported in Sunday’s edition.

The Cheaper than Dirt gun store in Fort Worth set a sales record for February, said store owner DeWayne Irwin, who described the rush as similar to one seen shortly after Obama’s 2008 election.

“We’re at the top of the roller coaster, and we’re about to plummet down the side,” Irwin told the Star-Telegram. “It’s fixing to happen again. I don’t know if it will be to the same extent it was before, but I see it coming.”

I’m skeptical about the reasons why, but I think it’s definitely happening. It could be that retailers are looking to capitalize on the current uncertainty and are talking up the idea of a panic. Or it could be totally legit.

I talked to one industry insider and he said there is definitely one underway. Of course posts like this one don’t help the situation, but since our readership consists of three guys in Colorado and my mom, I’m not too worried that this blog will make it worse.

However, yesterday I spent about $350 on three different websites and over at Bass Pro. I’m going to tell you what I bought, but it wasn’t gold.
